The Government approved the new General Telecommunications Law El Proyecto de Ley recupera la unidad de mercado y marca las bases para la inversi n en redes ultrarr pidas fijas y m viles.

El Consejo de Ministros ha aprobado este viernes el Proyecto de Ley General de Telecomunicaciones, a propuesta del Ministerio de Industria, Energ a y Turismo. La Ley actualiza la normativa para adaptarla a los profundos avances que ha vivido el sector de las telecomunicaciones y para favorecer el desarrollo futuro de la econom a digital, que el Gobierno considera uno de los pilares econ micos con m s potencial de crecimiento en nuestro pa s.

La nueva Ley busca crear el marco adecuado para facilitar las inversiones necesarias para el desarrollo de esta econom a digital, eliminando barreras y fomentando la competitividad y la protecci n del usuario. Entre las novedades, se simplificar el despliegue de nuevas redes, favoreciendo el uso compartido de infraestructuras entre compa as y eliminando trabas para la concesi n de licencias.

Adem s, la nueva Ley asegura la unidad de mercado y marca las bases para la inversi n en redes ultrarr pidas fijas y m viles.

El Proyecto de Ley actualiza la normativa vigente que data de 2003 y resuelve determinadas cuestiones que afectaban negativamente a la competitividad de los operadores de telecomunicaciones, como lo son la penalizaci n del despliegue de nuevas redes, la inversi n y la provisi n de servicios. Por su parte, los usuarios ver n mejoras en la cobertura, un incremento de la velocidad de Internet y la reducci n de precios y costes. Adem s, se mejora la protecci n al usuario.

La nueva Ley General de Telecomunicaciones se inserta dentro del Plan Nacional de Reformas que est llevando a cabo el Gobierno como parte esencial de la pol tica econ mica. sta se enmarca dentro del impulso a la econom a digital que el Ejecutivo ha puesto en marcha y cuyo eje central es la Agenda Digital para Espa a.

Principales modificaciones

El Proyecto de Ley General de Telecomunicaciones introduce reformas estructurales en el r gimen jur dico de las telecomunicaciones, con dos objetivos principales: facilitar el despliegue de redes de nueva generaci n, tanto fijas como m viles, ampliando su cobertura, y mejorar la oferta de servicios innovadores a los ciudadanos, de mayor calidad y a unos precios m s asequibles, impulsando unas condiciones m s efectivas de competencia.

La consecuci n de estos dos objetivos se lleva a cabo a trav s de la nueva normativa, que se basa en cuatro grandes pilares:

Impulso a la competencia y mejora de los servicios a los usuarios. La competencia es un instrumento esencial para garantizar unos mejores servicios a los usuarios finales, unos precios m s ajustados y que se mantenga el esfuerzo de inversi n e innovaci n caracter sticos del sector de las telecomunicaciones. De esta manera:

Se realizar n, de forma peri dica, an lisis de los distintos mercados, lo que permitir fijar en cada uno de ellos unas obligaciones espec ficas y unas condiciones de competencia m s adecuadas a la situaci n real del mercado.

Se mejoran los derechos de los usuarios de telecomunicaciones relacionados con la protecci n de datos de car cter personal y la privacidad de las personas. Se precisa el r gimen sancionador y se facilita el cumplimento de las obligaciones de los operadores manteniendo los derechos de los usuarios

Se simplifica la actuaci n de las Administraciones P blicas en la explotaci n de redes y provisi n de servicios de telecomunicaciones.

Se crea una Comisi n Interministerial sobre radiofrecuencias y salud para aumentar la confianza en la seguridad medioambiental.

Se refuerza la potestad inspectora y sancionadora por parte de la Secretar a de Estado de Telecomunicaciones y la Sociedad de la Informaci n

Recuperaci n de la unidad de mercado, de manera que los operadores de telecomunicaciones desarrollen su actividad en un contexto de reglas nicas en la toda la geograf a espa ola. Mediante esta actuaci n se complementa y refuerza la ley de garant a de unidad de mercado desde la legislaci n sectorial. Como principales medidas:

Se dise an nuevos mecanismos de coordinaci n y colaboraci n del Estado con las CCAA y las Entidades Locales para que se facilite el despliegue de redes de telecomunicaciones.

Se establecen requisitos t cnicos comunes para el despliegue de redes, as como l mites m ximos nicos de emisi n y exposici n a campos electromagn ticos en todo el territorio nacional.

Simplificaci n administrativa: se eliminar n las barreras normativas que las distintas Administraciones imponen al despliegue de redes y la prestaci n de servicios de telecomunicaciones.

Se simplifican los procedimientos administrativos estatales para acceder al uso del espectro radioel ctrico.

Se suprimen las licencias urban sticas y medioambientales para el despliegue de redes de telecomunicaciones en dominio privado. Las licencias ser n sustituidas por declaraciones responsables.

Facilitar el despliegue de redes: reducir los costes de manera que los operadores puedan ampliar la cobertura de sus redes y dispongan de mayor margen para trasladar a los precios finales dicha reducci n de costes.

Se facilitar el despliegue de las redes fijas de telecomunicaci n en los edificios y se garantizar el derecho de cualquier usuario a poder acceder a las redes ultrarr pidas, lo que implica que si un residente desea contratar servicios de redes ultrarr pidas, la comunidad de vecinos deber permitir el despliegue necesario para proporcionar ese servicio.

Otras modificaciones

La nueva Ley refuerza el control del dominio p blico radioel ctrico y modifica otros textos legales como la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Informaci n y de Comercio Electr nico introduciendo precisiones sobre las cookies. En este apartado, se clarifican las
